Terms of service
These terms apply to organisations that engage CognityHire for recruitment or subscribe to the CogniSense interview platform. Candidates do not contract with us and are never charged — see our security advice.

What we provide
Recruitment services, in which we run all or part of a search on your behalf, and the CogniSense interview platform, which you may subscribe to independently. Either can be bought without the other.
Subscriptions and interview hours
Platform access is sold as a subscription to a pool of interview hours drawn down as you hire. The rate depends on the seniority mix within the pool and on whether interviews are conducted in voice or text. Specific volumes, rates and terms are set out in your order.
Your obligations when assessing people
These are conditions of use, not recommendations.
- A person must review before any decision that affects a candidate's progress. Rejecting a candidate on an automated score alone is not a permitted use of the platform.
- You must not use an integrity signal as the sole basis for rejecting or accusing a candidate.
- You are responsible for the lawfulness of your own hiring decisions and for complying with the employment and data protection law that applies to you.
- You must not use the platform to assess anyone without their consent, or for any purpose other than assessing candidates for roles you are genuinely hiring.
- You must not attempt to reverse engineer the platform, or use it to build a competing product.
Who owns what
- The platform, our methodology, our evaluation frameworks and everything we develop remain ours.
- Your job descriptions, templates and hiring criteria remain yours.
- Work a candidate produces during an assessment — code, diagrams, written answers — remains the candidate's. You receive a licence to use it to evaluate that candidate for that role, and for no other purpose.
- Reports we generate are licensed to you for your hiring and record-keeping.
Candidate data
Where you run your own hiring on the platform, you decide how candidate data is used and we process it on your instructions. You are responsible for giving candidates the notices and collecting the consents your jurisdiction requires. How we handle that data is set out in our privacy policy.
What we do not promise
We do not warrant that any candidate assessed through the platform will be hired, will accept an offer, or will perform in the role. Assessment produces evidence for a decision; it does not make the decision, and no assessment predicts performance with certainty.
Scores are calibrated to be comparable rather than absolute. Where cohort data is still being established, comparability strengthens as evaluation data accumulates.
Availability and support
We aim to keep the platform available and will give reasonable notice of planned maintenance. Any service levels that apply to you are set out in your order rather than here.
Fees, term and termination
Fees, billing and the subscription term are set out in your order. Either party may terminate for material breach that is not remedied within a reasonable period after written notice. On termination you may export your reports; after the agreed retention window, data is purged.
Liability
Nothing in these terms excludes liability that cannot be excluded by law. Subject to that, neither party is liable for indirect or consequential loss, and our total liability is limited to the amount set out in your order.
Governing law
These terms are governed by the laws of India, and the courts at Pune, Maharashtra have jurisdiction, unless your order says otherwise.
